1. Interpretation and Definitions
Capitalized terms have the meanings provided in this Section or otherwise defined in these Terms.
- Application means the mobile application titled "Coffee List," including related features, tools, content, and updates.
- Company, We, Us, or Our means Maravista Software LLC, a Delaware limited liability company, with mailing address 8 The Green Ste R, Dover 19901, Delaware, United States.
- Service means the Application, Website, associated software, content, and any services offered by the Company.
- User Content means reviews, photos, saved items, preferences, notes, metadata, or other content submitted through the Service.
- Website means coffeelist.co and associated subdomains.
2. Agreement to Terms
Your access to and use of the Service is conditioned on your acceptance of these Terms and the Coffee List Privacy Policy. If you do not agree, you must discontinue use of the Service.
3. Eligibility
You represent that you are at least 13 years old. If you are between 13 and 17 years old, you may use the Service only with consent and supervision of a parent or legal guardian.
4. Coffee Information Disclaimer
Coffee listings, prices, availability, tasting notes, origin details, and roaster information are provided for discovery and convenience. This information may be incomplete, inaccurate, outdated, or changed by third-party roasters and merchants without notice.
5. User Content and License Grant
By submitting User Content, you represent that you own or have rights to it. You grant the Company a worldwide, royalty-free license to use, store, process, and analyze User Content solely to operate and improve the Service.
You agree not to upload unlawful, harmful, misleading, offensive, or infringing content.
6. Prohibited Uses
- Reverse engineering, scraping, or automated extraction except as permitted by law
- Circumventing protections or attempting unauthorized access
- Interfering with the Service's operation
- Uploading content that violates law or third-party rights
- Using the Service for competitive analysis without permission
7. Subscriptions, Billing, and In-App Purchases
Purchases and subscriptions may be processed through third-party platforms such as the Apple App Store and Google Play Store. Their terms govern payment processing, renewals, cancellations, and refunds. Subscriptions renew unless cancelled according to the applicable platform rules.
8. Third-Party Services and Links
The Service may link to roasters, shops, processors, app stores, and other third-party services. The Company does not control and is not responsible for third-party services, content, pricing, purchases, shipping, or privacy practices.
9. Intellectual Property
All rights in the Service, excluding User Content and third-party content, are owned by the Company or its licensors. You may not copy, modify, distribute, sell, or reverse engineer any part of the Service except as allowed by these Terms or applicable law.
10. Termination
The Company may suspend or terminate your access if you violate these Terms or use the Service in a way that creates risk for the Company, other users, or third parties.
11. "AS IS" and "AS AVAILABLE" Disclaimer
The Service is provided without warranties of any kind, express or implied. The Company disclaims warranties including merchantability, fitness for a particular purpose, accuracy, availability, and non-infringement.
12. Limitation of Liability
To the maximum extent allowed by law, the Company's total liability shall not exceed the greater of the amount you paid in the preceding 12 months or USD $100. The Company is not liable for indirect, incidental, special, consequential, or punitive damages.
13. Governing Law
These Terms are governed by the laws of the State of Delaware, without regard to conflict-of-law principles.
14. Arbitration and Class Action Waiver
Disputes must be resolved through binding individual arbitration administered by the American Arbitration Association, except where prohibited by law. Class actions and representative actions are not permitted.
15. Severability and Waiver
If any provision is invalid, the remaining provisions remain in effect. Failure to enforce a right does not constitute a waiver.
16. Changes to These Terms
The Company may update these Terms at any time. Material changes may be announced through reasonable notice. Continued use after updates constitutes acceptance.
